On June 10, the Center notified the Complainant that as the language of the registration agreement for the Disputed Domain Name was Romanian as per information provided by the Registrar , the Complainant would need to either provide satisfactory evidence of an agreement between the Complainant and the Respondent to the effect that the proceedings should be in English; submit the Complaint translated into Romanian; or submit a request for English to be the language of the proceedings, providing the reasons for such request. On June 13, the Complainant submitted a formal request for the language of these proceedings to be English. On June 16, the Respondent submitted a request by email for Romanian to be the language of the proceedings, providing a number of reasons for this. Pursuant to Rules, paragraph 11, in the absence of an agreement between the parties, or specified otherwise in the registration agreement, the language of the administrative proceeding shall be the language of the registration agreement, subject to the authority of the Panel to determine otherwise. According to information we have received from the concerned Registrar, the language of the registration agreement for the Disputed Domain Name is Romanian. In accordance with paragraph 11 of the Rules, the Panel has the authority to determine the language of proceedings. Having provided both parties with an opportunity to comment, any subsequent communication received by the Center from the parties regarding the language issue will be a matter for consideration at the discretion of the Panel on appointment. The Panel may choose to write a decision in either language, or request translation of either party's submissions.
